Query from Amar Peswani

We had held SGM to decide on contribution towards repairs of society. It was resolved that Rs.12/- sq ft will be collected from members. It was Rs 6 for previous year and Rs 6 for current circulars year.

Now society has raised the bill stating that previous years’ total dues i.e Rs 72 per sq ft to be cleared within 90 days. Failing which 21% interest would be charged. Is MC authorized to take decision which is contrary to SGM resolution?

Any demands on members must conform to a provision in registered bye-laws or resolution of the General Body if bye laws are silent. Bye Law provision prevails over Resolution.
