Since I don’t want to post on website for some reason, thought to email you this matter. My society (Saraf Choudhary Nagar CHS No.11 Ltd. KANDIVALI (E) Mumbai – 400101) is charging 5000/- as non-occupancy charges. I have been paying this from past 11 Years now. But recently I came to know society cannot charge more than 10% of the maintenance cost.

Request you to please guide as how I can get this fixed without any complications. As I stay at Bangalore with my family.

The Non-Occupancy charges are fixed in the general body meeting by virtue of a provision in the registered bye laws of the concerned Housing Society. Under an order of the Government No.SAGRUYO-1094/15165/ case No. 317/14-C /Mantralaya Extension, Mumbai- 32 dated 1stAugust 2001 there is a ceiling of 10% of Service Charges and any excess charge is in violation of this order. You have to demand refund of excess charge and if not refunded you file a dispute application in Cooperative Court. There is no way you can quietly resolve this issue with the Society.
