Can a person whose name does not appear on share certificate become Managing Committee member?

2. Can the co-op society by majority oppress one member by removing play area garden across only her flat on the ground floor?

1.Person whose name does not appear on share certificate cannot become managing committee member because the Maharashtra Co-operative Societies Election to Committee Rules, 2013 has a Proviso to Sub-Rule 1 of Rule 20 Nomination of candidates reading as under: Provided that, in case of joint or associate members, only the member whose name stands first in the share certificate shall be eligible to be nominated as candidate for the election.

2. Society by majority can oppress against one member by removing play area garden across only her flat on the ground floor and make parking as it does not require BMC approval, unless the approved plan shows garden.

3. Criminal complaint can be filed for financial fraud against managing committee members and the Auditors are obliged to file FIR after talking prior approval of the Registrar under recently amended the M. C. S. Act 1960?
