Limit of members in a Managing Committee.

Our society consists of 132 members and is situated in Mumbai. The managing committee consisting of 9 members has completed the term of 5 years. They are saying elections cannot be held till December 2014.

Also they claim that new members cannot be included in the managing committee till December 2014. As per new model bye laws of 2013 limit of managing committee members has increased to 13.

My query is:

1] What is the limit on number of members in the managing committee if our society has 132 members?

2] Can it co opt new members in the managing committee at this stage? And how many?

New Model Bye Laws will be of use to your Society after they are adopted by 2/3 members as your new bye-laws.

Your Committee tenure is extended till Elections are held by the State Cooperative Election Authority (not yet appointed)

If any member were to resign now and not more than 7 out of nine can resign, these vacancies can be filled by remaining members by co-opting suitable members to maintain the strength of nine.

Nothing else is possible as of now.
