Information on Non Occupancy charges

I wanted to have information on Non Occupancy charges. I have rented out my premises to L&T, in Mumbai, as guest house for accommodation of Civil Engineers, employed with them.

The society is levying Non Occupancy charges of 10% on the Rental agreement value, which is more than the monthly maintenance charges.

I assume Non Occupancy charges should be 10% of the maintenance charges and not on the rental amount.

Kindly do inform what is appropriate. And if you can forward any related law or article explicitly stating the same, would be helpful

Your information is correct. You can ask for Refund of excess amounts paid by filing a case in Cooperative Court if Society does not return voluntarily.

There is a Govt. Order No.SAGRUYO-1094/15165/ case No. 317/14-C /Mantralaya Extension, Mumbai- 32 dated 1st August 2001. This you can find on following website at page 67 of Housing Manual.
