How to start a housing cooperative ?

Question :

I want to know about housing co-operative as we wish to build residential houses for the needy with collective effort in Mumbai. The houses should also be affordable and within every body’s reach-Harish Pandey, Mumbai

Harrish has mooted a highly appreciable thought of building “residential housing for needy with a collective effort in Mumbai within an affordable rate and every body’s reach”. Most residential houses in Mumbai are under cooperative system due to scarcity of land.

The piece of land used for “cooperative house” first belonged to a fortunate owner, he having given developing rights to a Builder/Developer is not in picture any more, unless he becomes builder himself.

The Developer, while the house as per BMC approved plan is under construction starts entering into Sale Contacts of flats in terms of Bombay flats Act with hopeful residents/estate agents ( later though discouraged under law ) and take up the role of Chief promoter of a proposed cooperative housing society.

The Registering Authority under the MCS Act 1960 gives a registration certificate and certified  copy of registered Bye-laws which Chief promoter has filed with a registration application duly signed by himself and at least 12 members from 12 independent families, intending to reside in that Society. Once 60% flats are allotted filing Registration application is compulsory. Within 3 months the Society is registered because the time limit is also laid down in law.

Model Bye-laws are also available with its exclusive supplier the Mumbai District Housing Federation in Rs 45. You need three copies, minimum.  You may buy more to give to members later as the member has the right to receive copy of Bye-laws at costs.

As a Developer/ Promoter Harrish needs to tackle a burning issue of conveyance of title deeds but that he may not go into now at this stage.

So this is the co-operative system.
