How to fix maintenance charge in a co-op society

Kishen Kaul

I am owner of Two Bed room flat in cooperative housing society in Faridabad of Haryana state. In my society there are total of 50 Flats in which 18 are two bedroom flats and 32 are three bed room flats.

Society is billing maintenance cost same in both the flats. When pointed out that it should be as per SFT the management says that all are using common spaces and other things hence maintenance cost will be equal and it is as per cooperative societies act.

Kindly help me in this regards by telling what is right

The Basis is to be fixed by members in General Meeting by passing a Resolution to that effect. In Bye Laws also these basis are incorporated and in that case no change can be made without amending the bye Laws by 2/3 of the members present and voting are in favour of the amendment and Registrar registering the same.
