Our society is 3 year old. Builder has handed over charge to Society but Deemed Conveyance is pending yet.
Can Managing Committee charge fine on member who has done encroachment of common space in absence of the Conveyance.

Conveyance and charging penalty are not having any connection.
Society can levy penalty by following a procedure as prescribed in the Bye laws for breach of any bye law.
The Society in General body meeting must approve the rates of penalties for various breaches. If a member makes a breach as specified in the list he can be asked to explain why penalty as prescribed should not be charged and if General body is not satisfied member can be penalized.
