Election procedure for Co-op Housing Societies

We are a private co-op housing society having 47 members and established in 1955. Our Election to the Managing Society was due on 24-8-2013, which we have informed the Dy. Registrar.

We are getting two conflicting views regarding procedure for holding of elections

1. That we can hold the elect:after informing the Dy. registrar, whose officer would only preside over the election and later declare the result and

2. That the entire process of conducting the election and declaration of results would be done by the Dy. Registrar’s office.

Now the responsibility to hold elections in all cooperative societies is being entrusted to the State Cooperative Election Commission being set up hopefully by 31 12 2013, no elections or co-options can be done till such time. Maintain the Status quo.

Existing Committee should continue as a care taker committee. The law is your Society was supposed to have informed the State Election Commission 6 months before 24 8 13 i.e before 24 2 2013 (as per Clause 14 of Section 73CB which came in to force on 14 2 2103.

Since no Authority has been set up, such lapses have to be condoned.
