Corruption in Housing Society

Dr.P.K. Banerjee

I am a member of a cooperative housing society in Mumbai.  I have noticed misappropriation of society’s fund by the Managing Committee.

I have submitted documentary evidences to the concerned Dy Registrar of Cooperative Department with a request for re- auditing of Society’s account.  After due deligence, Dy Registrar has sent a letter to the Managing Committee mentioning that that one of his officer will visit at 11 AM on 12th March 2014 to examine society’s records.

On the due date MC refused to attend the Govt officer.  Subsequently MC filed an application u/s 152 of Maharashtra Cooperative act 1960 before Div JHt Registrar to set aside the “order” of the Dy Registrar.  Here MC is mentioning the intimation letter of the DR as an order.  Since Dy Registrar has not issued any order, this matter does not fall u/s 152 of MCA and  Div Jt registrar should not have admitted this “Appeal”. However, he is not taking any action and giving us long dates of around 3 to 4 months.

Please advice what should i do ?

File a Police Complaint submitting Evidence.
