Co-op: Can a foreign national get elected?

Sathish Duvvuru

I was a Indian Citizen and now I became a US citizen with US passport. I have a bought a flat in Big Apartment Complex and being a flat owner I have become the member of the society as per the bye-laws. Our Society is registered under “AP Societies Registration Act, 2001” and it is conducting elections for all the office bearer posts in near future.

Since the office bearer positions are of public in nature (since the society has Rs 12 crores of residents fund as corpus fund), am I eligible to contest the elections to the office bearer of our society.

Does the peoples’ act 1956 apply to the elections conducted under AP Societies Registration Act ?

In other words…can a foreign national get elected to one of the office bearer position of the society?

1.The officers of CHS are not public servants.

2. An Individual can become member of CHS if he is competent to enter in contract

3. Holding of immovable property by a foreign national is governed by Reserve Bank of India. It is quite procedure oriented. So consult a practitioner in these matters.

4. You can become office bearer provided you stay in the premises of the Society for a specified period as per the bye Laws of the Society concerned.
