Mrs. Shaikh

Who is responsible to see that the redevelopment of the Society is done as per Section 79A of the MCS Act?

Can the Dy. Registrar /Jt. Registrar say he can only ask the Society to go for Redevelopment as per Section 79A but in case the Society violates this Section, the Dy. & Jt. Registrar is helpless and cannot do anything to stop the same?

If there is a fraud in the account and if one of the members or a few members ask for the Account, can the Working/Managing Committee refuse the same and sit tight on it.

And what is the role of Dy. Registrar & Jt. Registrar in this regard?

I C Naik

1. Society is responsible to undertake redevelopment in accordance with the Circular issued by the State.

2. State cannot ask the Society to go for redevelopment.

3. Section 32 of the MCS Act 1960 gives a right to members to ask for copy of the audited accounts.

4. Where a fraud is suspected, members can write to the Dy Registrar about the same and he will get it investigated. If he does not take action write to the District Deputy Registrar.
