CHS: Non-occupancy charges

I stay at Navi Mumbai, Maharashtra. As per the Bye- laws of Maharashtra Co-op Housing Society , Non- occupancy charges are to be levied at the rate of 10% of Service charges paid.

I have another flat at Panaji – Goa which is given on rent. The Housing Society has sent me a notice asking me to pay non-occupancy charges at the rate of 5% of the rent paid. They further state that this is as per rule no. 133 and 06 of the Goa Co-operative Housing Society Act.

Kindly let me know whether I have to pay 5% of rent or I am misguided by Society office bearers from Goa. Further, please inform the provisions made in the By-laws of Goa CHS Act as regard to Non-occupancy charges.

File an application with the Secretary and ask for certified copy of the bye laws of your society in Goa. You will have to pay zeroxing charges to secretary as he will tell you. Then you find in relevant bye laws about the rate. This rate differs from state to state and chs to chs. The Members in GBM decide the rate as per guidelines issued by the State if any.

    Dear Sir,

    We stay at Vasco- Goa. We have a lady who owns a flat.The lady does not stay in the flat. However her married daughter along with husband and children are occupying the flat. Our society charges, non occupancy charges as per Goa State Coop Act 2001. Cud you pl tell us whether they are applicable to the married daughter? or are they exempt as she is the daughter of the owner.
