Case of “Deficiencies in Services”

I stumbled upon your site while browsing the net and was impressed with your replies, hence am sending this mail to address a few grievances we are facing with Lodha Dwellers , Dombivali, Mumbai.

  1. Is the chief promoter bound to hand over all relevant documents including accounts for all amounts paid to him including society formation charges, contract copies with vendors.
  1. We are a cluster of six buildings having a total of 288 flats and totally the builder has charged us RS. 90 lacs to form our society but in the accounts statement has mentioned only RS. 5000.00
  1. He handed over flats before OC mentioning fit out by making us sign an affidavit that maintenance starts with immediate effect and has deducted RS. 1500.00 x 288 x 2 years as electricity and water bills on an adhoc basis mentioning no meters were installed.
  1. Out of 6 buildings 4 buildings maintenance amount paid for 2 years have finished , he handed over society after 15 months and the balance 2 buildings maintenance of 7 months lying with him has been adjusted with the 4 buildings and has given us an of 10.50 lacs debit balance at time of handing over society putting us in a very tight spot as running the society is impossible.

As those members who have receipts for maintenance paid to the builder are refusing to pay to society.

This is a fit (quite Serious) case of “Deficiencies in Services” This Clause has a lot significance under Consumer Protection Act 1986. Several cases are reported recently wherein a District Consumer Protection Court has directed builder/developer to make good al deficiencies of the likes faced by members of your society.

Although Advocates are not required to present your case you may consider roping in a C A to fight your case as a lot of numbers are involved far more important than the legalities.
