I am living in Mumbai, Maharashtra in one of the Co operative Housing Society. The Flat is registered on my name. My brother who is physically handicapped is also staying with me. He is using four wheeler Scooter and was Parking his Scooter in society compound and Society was charging him, Car Parking rate giving logic, that Scooter has Four Wheel and writing Car Parking in Maintenance Bill.
This was continuing for last three years, now he bought small Handicapped Car and started Parking in the same place. The Society took objection saying, you cannot Park Car, it has to be Scooter only, our argument is when you are charging Car Parking Rate, writing also Car Parking in Maintenance Bill and over and above he is handicapped then why cannot he Park the CAR? WE ARE PLANNING TO GO TO COURT. Please advise.

Car Parking Rules are ingrained in bye laws. You need to study your bye laws on car parking and see if a legitimate service to members is not provided by the Society. If you are convinced you hace a good case before Consumer protection Court.
