I wish to know that a Flat in the name of Wife only and she is a office bearer,  but she want to resign the post and want her husband to be the Office bearer,  her husband  is  an Associate member, and the present managing committee have no objection to induct him as a office bearer, can he eligible for the post of  Officer bearer of the society.

I C Naik

Associate member can become member of the managing committee and if elected by the managing committee he/she can be an office bearer, as the position stands today. Bye Law No 118 (Model 2009 of Maharashtra cooperative housing societies) supports this conclusion notwithstanding Bye Law No 25 confers right of voting in the general body meeting in the absence of original member. the Maharashtra Co-operative Societies Election to Committee Rules, 2013 prohibits associate member to be nominated for election to the managing committee.

    Dear Sir,

For a member to become a office bearer, is it necessary to spend certain number of years as a member of the society. I have been told by my chairman to spend atleast two years as member before becoming the office bearer.

    Thanks
    Neeraj
