Ac woes: Query from Rajiv Jain

Respected sir,

I have a shop in CHS in Mumbai at the ground floor and I am facing a problem from last two months.  My neighboring shop have installed spilt AC in his shop and he had fitted the cooling unit outside his shop on ground in such a way that all hot air emitted by cooling unit of AC is directly entering my shop creating lot of problem for me. I had brought the problem to his notice but he is not ready to listen saying that he had fitted the unit outside his shop and no one can stop him from doing so.

I had informed to chairman of our society about the problem and he told me that society had not given any noc to use open space and installation of cooling unit, and he will talk to him.  But till date they have not taken any action. so please do needful to guide me, what action can I take against the shop owner and how can managing committee help me in this case

If AC vent is within Society Building Compound the Committee is responsible to control inconvenience caused to members. This is a case of deficient service to member by the Committee. File a Consumer Complaint in Consumer Court against Committee to remove AV went and damages may be Rs 10 to100 per day which the Committee members are liable to pay for their inaction. This is backed by Bye laws as also MCS Act 1961 (Section 73[1AB].
