The Orissa High Court has dismissed a PIL seeking directions to revive all dormant cooperative societies and ensure proper functioning of regulated market committees, media reports say.
A division bench of Chief Justice Harish Tandon and Justice MS Raman held that Section 40 of the Odisha Cooperative Societies Act, 1962 only states the objective of promoting cooperatives and does not create an enforceable right.
The court said the Act provides a complete statutory mechanism for regulation, winding up and revival, and a general PIL cannot bypass remedies available under law.
