IFFCO elections: Arbitrator appointed in dispute between Jadhav vs Kasturkar

The Central Registrar of Cooperative Societies Rabindra Kumar Agarwal has appointed Kalyan Sahai Meena, IAS (Retd.), as the Arbitrator to settle the dispute between Smt. Sadhna Laxmanrao Jadhav and the Indian Farmers Fertiliser Cooperative Limited (IFFCO) regarding the election to the Board of Directors of IFFCO from Constituency No. XIII.

The appointment has been made under sub-section (4) of Section 84 of the Multi State Cooperative Societies Act, 2002, in accordance with the provisions of the Arbitration and Conciliation Act, 1996 read with Section 84 of the MSCS Act, 2002.

The dispute arises from a complaint filed by Smt. Sadhna Laxmanrao Jadhav challenged the eligibility of Smt. Varsha Kasturkar, who was recently elected to the IFFCO Board under the women’s reserved category. The complaint alleges that her election raises issues regarding the constitution and management of the society- Kunbi Sheti Upyogi Krushi Vyavsayik Sahakari Sanstha Ltd.-which she represents.

The Arbitrator has also been directed to decide on the request for condonation of delay in filing the application for appointment of arbitrator under Section 85(3) of the MSCS Act, 2002, citing health reasons.

As per the order, the proceedings shall be governed by the Arbitration and Conciliation Act, 1996, including the fee and other expenses of the Arbitrator. The appointment of Kalyan Sahai Meena will remain valid for a period of six months from the date of the order, unless extended by the authority for sufficient cause.
