The Bombay High Court has set aside an earlier Industrial Court order and directed Nashik District Central Co-operative Bank to undertake an exercise for the regularisation of certain employees who had approached the court alleging unfair labour practices.
In a judgment delivered on March 5, 2026, Justice Amit Borkar allowed a batch of writ petitions filed by employees working in various posts such as clerks and peons. The petitioners had challenged a May 20, 2022 order of the Industrial Court, Nashik, which had dismissed their complaints.
The employees contended that they had been working for several years on temporary or consolidated wages despite performing duties of a perennial nature and against existing vacancies. They alleged that they were denied the benefits available to permanent staff.
After examining the record and admissions made during the proceedings, the High Court held that the bank had engaged in unfair labour practices by continuing the employees on temporary status for prolonged periods.
The court directed the bank to conduct a regularisation exercise within 12 weeks, subject to verification of eligibility and qualifications.
