Outdated Bye-Laws: CEA pauses elections of two MS Co-ops

The Office of the Co-operative Election Authority (CEA), under the Ministry of Cooperation, has directed two multi-state cooperative credit societies to amend their bye-laws in line with the Multi-State Co-operative Societies (MSCS) Act, 2002, as amended in 2023, before elections can be conducted.

In separate communications issued on Thursday, the CEA informed Manav Kalyan Credit Co-operative Society Ltd., Delhi, and Janta Raja Multistate Cooperative Credit Society Ltd., Maharashtra, that their existing bye-laws do not adequately reflect key provisions introduced through the 2023 amendments.

The Authority noted that the bye-laws fail to incorporate provisions relating to elections being conducted by the CEA, filling of casual vacancies, and other statutory requirements.

In the case of Janta Raja Society, the CEA also pointed out the absence of provisions for women and SC/ST directors.

Both societies have been directed to prepare and publish on their websites the list of eligible members as on March 31, 2026, while simultaneously amending their bye-laws in line with the provisions of the amended MSCS Act, 2002.

The CEA has made it clear that the election programme will be issued only after the amended bye-laws are approved and submitted to the Authority.
