Our co-op hsg. society is holding a Special General Meeting in the next 10 days. We have decided to conduct a voting by Poll for an agenda item whose expenditure runs into Lacs of Rupees

Query 1 :

The builder of our society has 7 Shops in the society for which separate individual share certificates are issued. He is the owner of all the 7 shops .He is demanding that seven voting slips be given to him. Would it contravene the principle of “one member one vote” . Request your opinion

Query 2 :

It is a understood fact that the chairman can only put in a casting vote. Can the committee members like the secretary, treasurer and other committee members participate in the poll and cast their vote as members of the housing society

I C Naik

As per Section 27 of M C S Act 1960 a member can cast one vote even if he holds more than one flat.

All Committee members can cast one vote each and in case votes on any proposal are equal on both sides i.e. for and against Caiman has a casting vote which will decide the proposal’s fate.
