In a significant order balancing administrative intervention with electoral fairness, the Delhi High Court has directed that elections to the Governing Council of the National Cooperative Union of India (NCUI) be conducted within a fixed timeline, while clarifying limits on the powers of an Administrator appointed by the Centre.

The bench of Justice Prathiba M. Singh and Justice Madhu Jain was hearing a petition filed by Krishi Pragati Cooperative Ltd., which challenged a January 19, 2026 order of the Central Registrar of Cooperative Societies appointing an Administrator to manage NCUI’s affairs. The government had stepped in after the tenure of NCUI’s Governing Council ended in November 2025 without fresh elections, creating what it described as a governance vacuum.

The Court noted that under the Multi-State Co-operative Societies Act, 2002, the Centre is empowered to supersede a governing body and appoint an Administrator in situations where elections are not conducted in time. Given the admitted position that NCUI’s term had expired and elections had not taken place, the Court did not interfere with the appointment of the Administrator. It observed that such a step was aimed at restoring functional continuity and enabling timely elections.

At the same time, the Court emphasized that the Administrator’s role is limited and must remain confined to facilitating elections in accordance with the law. Accordingly, it directed that the election schedule be notified by April 30, 2026, and the entire process be completed by July 31, 2026, ensuring a time-bound restoration of an elected body.

A key issue before the Court concerned the participation of three entities, National Cooperative Export Limited, National Cooperative Organics Limited, and Bharatiya Beej Sahakari Samiti Ltd., which were granted membership of NCUI after the Administrator took charge in January 2026. The petitioner argued that allowing these new members to vote would alter the electoral balance.

Relying on settled Supreme Court precedents, including K. Shantharaj vs. M.L. Nagaraj and Joint Registrar of Cooperative Societies Kerala vs. T.A. Kuttappan, the High Court held that an Administrator does not have the authority to enroll new members for the purpose of elections. The Court reiterated that while an Administrator can manage routine affairs and conduct elections, the electoral roll must remain as it stood at the time of supersession.

Accepting this legal position, the Court directed that the electoral roll for the upcoming NCUI elections shall be frozen as on January 19, 2026. Only limited changes, such as substitution of legal heirs or procedural corrections, would be permitted. This ensures that the election process remains consistent with the principle that an interim authority should not influence the composition of the electorate.

Importantly, the Court chose not to rule on whether NCUI qualifies as a “specified multi-state cooperative society,” leaving that question open. This indicates a restrained approach, focusing on immediate electoral concerns rather than broader classification issues.

Overall, the judgment underscores a calibrated approach: it upholds the government’s intervention to break an administrative deadlock, while reinforcing judicial safeguards to ensure that the electoral process remains fair, transparent, and insulated from interim alterations.
