The Karnataka High Court invalidated Section 128-A of the Karnataka Cooperative Societies Act, 1959, ruling it unconstitutional. This section empowered the Registrar to control the recruitment, transfer, and disciplinary actions of cooperative society employees, says media reports.
Such powers infringe on the autonomous functioning and democratic control guaranteed under Article 43-B and Article 19(1)(c) of the Indian Constitution, the court noted.
The court examined petitions from several cooperative societies challenging the amendment, arguing it violated their constitutional rights.
