Mishra’s dismissal: Can Central Registrar overturn NCUI resolution?

There is raging controversy on the issue of the tenability of resolution passed against NCCT Secretary by the Governing Council in its Tuesday meeting. While some say the decision of GC could be overturned by the Ministry as it was not unanimous, there are others who say the Central Registrar has no role in the matter.

It bears recalling that Sikkim co-operator Mangal Jit Rai, who is also an active Sahakar Bharati member, has submitted his note of dissent against the resolution. Indian Cooperative has both a copy of Rai’s note of dissent as well as the Central Registrar’s circular on the issue.

Rai wrote “There is no merit in the proposed action against Shri Mishra. Kindly take my dissent note. We all know his permanent absorption to the post of secretary NCCT was made by the then administrative ministry i.e. agriculture and farmers welfare which is also the administrative ministry of NCUI. There is no fault on the part of Shri Mishra and NCUI should take the issue of no objection to the administrative ministry. Therefore, I do not support the proposal. This will further antagonise the government.

Therefore, as per various directions of the administrative ministry to NCUI, his service dues may be released by NCUI without further delay”, wrote Mangal Jit Rai.

Rai’s dissent may disallow NCUI from achieving its goal of getting rid of Mishra, said some co-operators. They were referring to a Circular (Under section 108 of the Multi-State Co-operative Societies Act, 2002) sent by Vivek Agarwal, Central Registrar to all the multi state co-op societies.

The Circular reads “In exercise of the powers conferred under Section 108 of the Multi-State Co-operative Societies Act, 2002, for the multi-State cooperative societies located in various States and Union Territories, it is directed that minutes proceedings recorded as per provisions of Section 110 of the Act, with regard to such Board decisions which have been taken by voting of majority members and not on unanimous basis, shall be sent to the office of Central Registrar of Cooperative Societies, within seven days of such Board meetings.”

The GC was also reported to be somewhat critical of Sahakar Bharati’s role in the matter, in its meeting on Tuesday. “Not good words were spoken about us”, said a senior Sahakar Bharati member to Indian Cooperative.

Though there is no reason for Sahakar Bharati to defend Mohan Mishra, it has always believed that NCCT should be independent of NCUI and should be allowed to function as an autonomous training institute setting global standards. It is no secret that Sahakar Bharati did play a role in the creation of NCCT by convincing Radha Mohan Singh on the issue.

Ironically, NCUI is today headed by a man who is ideologically closer to Sahakar Bharati than to the older lot of NCUI leaders. Three-time MP and an erstwhile Minister in Gujarat Cabinet, NCUI President Dileep Sanghani is a committed BJP man.

But on the issue of NCCT he is not on the same page with Sahakar Bharati. The situation is tough for two factions of the same Parivar and the earlier it is sorted out the better, said a senior Sahakar Bharati leader to Indian Cooperative.
