My society is registered under Multi-State Cooperative Societies Act, 2002.  My society has more than 16000 individual members scattered all over India.

These 16000 members elected their Delegates to constitute a General Body.   All 16000 members are Government employees.

Society Bye-law states that the Board of Directors shall group the members of the Society into convenient groups on the basis of Ministry / Department and its attached and subordinate Offices / Undertaking / Places or the place where they are employed or were last employed for the purpose of elections of delegates.

But, the Board of Directors has not created any group of members in Uttaranchal, Madhya Pradesh, Haryana, Mumbai, Kerala and Rajasthan etc. for the purpose of elections of Delegates.

Section 31 of the Multi-State Cooperative Societies Act, 2002 states that every member of a multi-state cooperative society, shall have one vote in the affairs of the society.

Returning Officer has not send intimation concerning election to each member of the Society and he has also not directed the society to affix the Notice on the notice board of the Society branches situated outside Delhi.   Board of Directors of the society has also not published Notices about Election of Delegates in the newspapers published from these States.

I, therefore, want to know from you as to whether, the Board of Directors and the RO have infringed the rights of members of these States and deprived them from exercising their Right to Vote and their Right to Elect or not.
