Can a member who has been served notice by Managing Committee for illegal alterations to his flat changing location of kitchen to bathroom and dry to wet areas since last 5 years and who has not submitted letter from Structural Engineer from BMC authorizing the same be elected to be member of Managing Committee?.

Mere serving a Notice does not make an accused (somebody being charged with wrongdoing in a criminal case) guilty (in the wrong) until proved according to prescribed process. So he is no different from any other member.
