I am from Borivali Snehal Co-op hsg Society, Borivali, Mumbai (maharashtra). Society is of 20 members. Elections were held on 28th May 2015 and a six member committee was elected in which I was one committee member . Since, I was not to be in India for 6 month, I did not accept any post. However, when I returned back to country, all committee members decided to elect me as Secretary as the originally elected Secretary resigned but still wanted to continue as committee member.
However, a CRIMINAL Lawyer of our Society has taken objection on this re-shuffle of the post within elected committee. Will be such re-shuffle of post be legal?

Electing Office Bearers is the exclusive prerogative of the elected members of the Committee and no member outside the Committee has any say. Ask your Criminal Lawyer to raise a dispute before Cooperative Court under Section 91 and say that the Committee will abide by the Order of the Court. Needless to say the Court will not accept the Complaint. The Criminal Lawyer has a good chance of loosing his licence.
