The Flat in Mumbai is in the name of my father, mother and me, first name is mine.

Since my mother is expired ten years back and daddy expired 2 months back, the society is asking for NOC of my sisters for transferring the flat.

Does it really required by society for such NOC.

I C Naik

I suggest you buy a copy of the Bye law (Rs 100 approx) from the Secretary as he is duty bound to provide and ask the Secretary to show you the Bye law Number under which the flat is to be transferred? Since you are the member, question is to whose name the Secretary wants you to transfer the flat? Question of NOC arises where a flat is to be transferred and not otherwise.

Also ask the Secretary which form is to be signed by your sisters to give NOC to the Secretary and ask him to help you fill it up.. Secretary will get some knowledge under this exercise. So I sincerely suggest you to pursue this exercise at leisure. Nothing will be lost as far as you are concerned if you simply keep quiet and do nothing, as no action arises on your side. But please use this opportunity to educate the Secretary.
