Obnoxious issue of leakage

We stay in a flat and there is a leakage happening from the upper floor bathrooms into our bathrooms with the result that the paint and plaster has come off and water droplets are falling continuously. This has been happening for over a year and neither the owner of the flat on the upper floor and nor the Managing Committee of the society are taking any action to remedy this .We have written letters along with photos of the leakages and been sending email and also letters to them with photographs.

We are senior citizens and hence are worried about the leakages and droplets may cause one of us to slip and hurt which can be disastrous and result in severe injury

Kindly advise what the recourse available to us.

In a similar situation members have gone to Consumer Court and got the orders passed directing the Society to get the leakage attended. The case is called deficiency in service by the Society to its members.

You can yourself write to the District Consumer Forum and talk to the judge yourself when you are called and the Secretary is called. You should also claim damages caused to your flat.

You should also plead and ask for Committee to bear the amount that may be ordered as it is the Committee’s negligence in performing its duty. You should get orders in 3-6 months. Please inform the Dy Registrar of your Ward in writ ting before going to the Court.
