Chairperson Removal: CEA seeks explanation from TN based Society

The Cooperative Election Authority (CEA) has issued a show-cause notice to Tamil Nadu-based Manarang Manufacturing Multistate Industrial Cooperative Society Ltd. over the purported removal of its Chairperson, A. Lakshminarayanan, through a no-confidence resolution.

The CEA has sought detailed information on the meeting where the resolution was passed and the subsequent appointment/election of new office-bearers. The society has been asked to submit the meeting notice, agenda and proof of service to members, along with the precise grounds for moving the no-confidence motion.

The Authority also sought certified copies of the proceedings and minutes, attendance records, quorum details, voting records and details of any objection, dissent or abstention.

The CEA further asked whether Lakshminarayanan was informed in advance of the grounds for the motion and given a reasonable opportunity to explain his position. Relevant notices, his explanation and hearing records have also been sought.

The society has also been directed to provide the bye-laws relied upon for the removal.

Regarding the successor, the CEA said the appointing authority has the power to fill a casual vacancy. It also referred to the five-year term of elected Board members and office-bearers and the provisions governing vacancies.

The society has been given 15 days to respond.
